By accessing and using Photos.Chat (operated by Hustle Ventures) services through WhatsApp or any other medium, you accept and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.
2. Service Description
Photos.Chat provides AI-powered style transformation services for portrait photographs. We use third-party AI models (including Replicate AI and Google Gemini AI) to process and transform your images.
Service Operator: This service is provided by Hustle Ventures through the Photos.Chat platform.
3. Eligibility and Age Requirements
You must be at least 13 years of age to use our services. By using Photos.Chat, you represent and warrant that:
- You are at least 13 years old
- You have the legal capacity to enter into this agreement
- If you are under 18, you have parental or guardian consent
4. Photo Ownership and Usage Rights
4.1 Your Photos
You retain all ownership rights to the photos you upload to Photos.Chat. By submitting photos, you grant us a temporary license to:
- Process your photos using our AI transformation technology
- Store your photos for up to 10 minutes for processing purposes only
- Deliver the transformed images back to you via WhatsApp
4.2 Image Storage and Deletion
Photos.Chat does NOT store your images beyond 10 minutes. All uploaded and processed images are automatically deleted from our servers after the processing window expires.
4.3 Marketing Usage
Transformed photos may be used for marketing purposes ONLY if you explicitly grant permission. We will always ask for your consent before using any transformed image for promotional purposes.
5. Acceptable Use Policy
5.1 Prohibited Content
If prohibited content is detected:
- The transformation will FAIL immediately
- Your points will be DEDUCTED (no refunds)
- Repeated violations may result in account suspension
5.2 Photo Quality Requirements
For best results, you must provide:
- Clear, well-lit individual portrait photos
- Good resolution (minimum 512x512 pixels recommended)
- Single person in the photo (group photos may not work properly)
- Face clearly visible and not obscured
6. Payment and Pricing
6.1 Points System
Our service operates on a points-based system. You purchase points in bulk packs, and each photo transformation costs 2 points.
6.2 Current Pricing
- Starter Pack: ₹99 for 10 points (5 photos)
- Standard Pack: ₹199 for 22 points (11 photos)
- Premium Pack: ₹299 for 36 points (18 photos)
Prices are subject to change. Current pricing is always displayed in the app and on our Pricing page.
6.3 Payment Processing
All payments are processed securely through Razorpay. We accept UPI, credit cards, debit cards, and net banking. Photos.Chat does not store any payment information.
6.4 Points Never Expire
Once purchased, your points remain valid indefinitely and never expire.
7. Refund Policy
We do NOT issue refunds in the following situations:
- Erroneous or unsatisfactory transformations (due to third-party AI limitations)
- Failed transformations due to prohibited content (NSFW)
- Failed transformations due to poor photo quality
- User error or dissatisfaction with AI results
- Change of mind after purchase
By purchasing, you acknowledge and accept that this is experimental technology with variable results and that all sales are final.
8. Third-Party Services
Our service relies on third-party AI providers:
- Replicate AI: For style transformation processing
- Google Gemini AI: For image analysis and processing
Your photos are processed according to the terms and conditions of these third-party services. We are not responsible for any issues arising from third-party service failures or limitations.
9. Service Availability and Performance
9.1 No Guarantees
We do NOT guarantee:
- Uninterrupted service availability
- Specific transformation quality or accuracy
- Specific processing times (though we aim for 2-5 minutes)
- Compatibility with all photo types or styles
9.2 Maintenance and Downtime
We reserve the right to perform maintenance, updates, or suspend services temporarily without prior notice.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Photos.Chat is provided "AS IS" without warranties of any kind
- We are not liable for any direct, indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount you paid for the specific service
- We are not responsible for third-party AI model failures or errors
11. Intellectual Property
The Photos.Chat platform, including its design, features, and branding, is the intellectual property of Hustle Ventures. You may not copy, modify, distribute, or reverse engineer any part of our service.
12. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
13. Account Suspension and Termination
We reserve the right to suspend or terminate your access to Photos.Chat if you:
- Violate these Terms and Conditions
- Submit prohibited content repeatedly
- Engage in fraudulent or abusive behavior
- Attempt to exploit or harm our service
Upon termination, any unused points are forfeited without refund.
14. Changes to Terms
We may update these Terms and Conditions at any time. Changes become effective immediately upon posting. Your continued use of Photos.Chat after changes constitutes acceptance of the modified terms.
15. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in [Your City/State], India.
